Welcome to Articulate AI. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Articulate AI ("Company," "we," "us," or "our") governing your use of the Articulate AI mobile application ("App") and any related services. Articulate AI is an iOS app that helps users improve their communication and public speaking skills through AI-powered speech analysis, real-time transcription, interactive speaking games, and personalized feedback.
Please read these Terms carefully before using the App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
By creating an account, accessing, or using Articulate AI, you confirm that you are at least 13 years of age (or the minimum age required by applicable law in your jurisdiction) and that you accept and agree to comply with these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
These Terms apply to all users of the App, including users who sign in via Sign in with Apple, Google Sign-In, or Email OTP authentication.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use.

This license is governed by and subject to the Apple Licensed Application End User License Agreement ("Apple EULA"), which is incorporated herein by reference. In the event of any conflict between these Terms and the Apple EULA, the Apple EULA shall prevail with respect to your use of the App obtained through the Apple App Store.

Articulate AI offers auto-renewable subscriptions (monthly and yearly plans) to access premium features. By subscribing, you agree to the following:
All subscription payments are processed by Apple. We do not directly collect or store your payment information. Refund requests must be directed to Apple in accordance with their refund policies.
When you use Articulate AI, you may create content such as speech recordings, transcriptions, game results, and practice data ("User Content"). You retain ownership of your User Content.
By using the App, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing and improving the App's services to you. We will not sell or share your User Content with third parties except as described in our Privacy Policy.
You are solely responsible for the content you create and share using the App. You agree not to use the App to record, transcribe, or process any content that is illegal, defamatory, or that infringes on the rights of others.
Your privacy is important to us. Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

Violation of these prohibitions may result in immediate termination of your account and access to the App.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms or conduct that we determine to be harmful to other users or our business.
You may terminate your account at any time by deleting your account from the Account screen within the App. Upon termination, your license to use the App will immediately cease.
Termination of your account does not automatically cancel any active subscription. You must separately cancel your subscription through your Apple ID account settings to avoid future charges.
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The App is designed as a communication improvement tool and does not provide professional speech therapy, medical advice, or clinical diagnosis. Always consult a qualified professional for speech-related health concerns.
To the maximum extent permitted by applicable law, in no event shall Articulate AI, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with:
In no event shall our total aggregate liability to you for all claims arising out of or relating to the use of the App exceed the amount you have paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
You agree to indemnify, defend, and hold harmless Articulate AI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your infringement of any rights of another party.
We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you via the App or email. Your continued use of the App after any changes to these Terms constitutes your acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy and any applicable Apple EULA, constitute the entire agreement between you and Articulate AI regarding the use of the App and supersede all prior agreements, understandings, and representations.
